Terms of Service

1. Agreement to Terms

By accessing or using Lexi Connect (“the Service”), operated by Experience Email, LLC (“we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

These Terms apply to all users of Lexi Connect at lexiconnect.app and experience.email, including users who access the Service through the Shopify App Store or other marketplace installations.

2. Description of Service

Lexi Connect is an interpreted data feed for ecommerce teams. It connects to your ecommerce and marketing platforms — including Shopify, Klaviyo, Attentive, Meta Ads, Google Ads, and Notion — to deliver daily AI-powered cross-channel analysis, performance insights, and prioritized action items directly into your Notion workspace.

The Service includes:

  • OAuth-based platform connections for data ingestion
  • Historical data backfill from connected platforms
  • Daily automated analysis using AI (Anthropic Claude API)
  • Morning Insights executive briefings delivered to Notion
  • Action Items (tickets) with severity scoring, team assignment, and deep links
  • Structured databases for ecommerce, email/SMS, paid ads, and campaign data in Notion
  • A Setup database for customizing performance benchmarks and team assignments

3. User Accounts

You must create an account to use the Service. You are responsible for:

  • Providing accurate and current account information
  • Maintaining the security and confidentiality of your password
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

You may not share your account credentials with others. Each user must have their own account. Agency accounts with multi-brand access must be managed through the agency dashboard.

4. Platform Connections and Data Access

4.1 OAuth Authorization

When you connect a platform (Shopify, Klaviyo, Attentive, Meta Ads, Google Ads, or Notion), you authorize Lexi Connect to access specific data from that platform via OAuth. You can review the exact scopes requested during each authorization flow. You may revoke access at any time by disconnecting the platform from the Connections page or revoking access from within the platform's own settings.

4.2 Read-Only Access

All platform connections except Notion are read-only. Lexi Connect does not write to, modify, or delete any data in your Shopify store, Klaviyo account, Attentive account, Meta Ads account, or Google Ads account. Notion is the sole destination where Lexi Connect creates and updates content (database rows for metrics, insights, and tickets).

4.3 Data Accuracy

Lexi Connect processes data as received from your connected platforms. We do not guarantee the accuracy, completeness, or timeliness of data provided by third-party platforms. Analysis and insights are generated based on available data and should be used as one input to your business decisions, not as the sole basis for action.

4.4 AI-Generated Content

Morning Insights, ticket descriptions, and executive summaries are generated by AI (Anthropic Claude API). While we design our analysis prompts to produce accurate and actionable output, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing AI-generated recommendations before taking action. We are not liable for business decisions made based on AI-generated content.

4.5 Third-Party Platform Availability

The Service depends on the availability of third-party platforms (Shopify, Klaviyo, Attentive, Meta, Google, Notion, Anthropic, Supabase, Vercel). Service availability and data freshness may be affected by outages, rate limits, or API changes at these third-party platforms. We are not responsible for disruptions caused by third-party service issues.

5. Subscription and Billing

5.1 Free Trial

New accounts receive a free trial with full access to all features. No credit card is required to start a trial. Trial duration may vary based on your installation method. When the trial expires, you must select a paid plan to continue using the Service.

5.2 Subscription Plans

Plans are based on your monthly Shopify order volume. All plans include every feature — the only difference between plans is the monthly order limit. Plans are available in monthly, quarterly (10% discount), and annual (20% discount) billing terms.

5.3 Billing Providers

Depending on how you installed Lexi Connect:

  • Direct signup (lexiconnect.app): Billed through Stripe, Inc. Fixed monthly/quarterly/annual pricing based on your selected tier.
  • Shopify App Store: Billed through Shopify. Usage-based pricing that auto-scales with your order volume.

By subscribing, you authorize recurring charges to your payment method. We do not store complete payment card information on our servers.

5.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period at the then-current rate. Your payment method will be charged automatically unless you cancel before the renewal date.

5.5 Order Limits

Each plan includes a monthly Shopify order limit. When your order count exceeds your plan's limit, daily analysis and Notion sync will pause until the next billing period or until you upgrade to a higher tier. You will receive notifications as you approach your limit. We do not charge overage fees.

5.6 Plan Changes

You may upgrade or downgrade your plan at any time from the Billing page. Upgrades take effect immediately. Downgrades take effect at the end of your current billing period.

5.7 Failed Payments

If payment fails, we will attempt to charge your payment method multiple times over a 7-day period. During this time, the Service continues in a limited state. If payment cannot be processed after the retry period, your subscription will be suspended.

5.8 Cancellation

You may cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of your current billing period — you retain full access until then. After cancellation, your platform connections and configuration are preserved for 30 days in case you resubscribe. After 30 days, data may be permanently deleted.

5.9 Refund Policy

We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied, request a full refund within 14 days of your initial purchase by contacting support@experience.email. Refunds are not available after 14 days. Subsequent billing period charges are non-refundable. Refunds are processed to your original payment method within 5-7 business days. 6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access data belonging to other users or tenants
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with the Service's infrastructure, including overloading servers or circumventing rate limits
  • Resell, sublicense, or redistribute access to the Service without written permission
  • Use the Service to collect or store personal data of individuals beyond what is necessary for your legitimate business use
  • Connect platforms or accounts you do not own or have authorization to access
  • Submit false or misleading information

7. Your Data and Content

You retain all rights to your data. We do not claim ownership of any data you provide or that is collected from your connected platforms.

By using the Service, you grant us a limited, non-exclusive license to access, process, and store your data solely for the purpose of providing the Service — including generating analysis, insights, and syncing content to your Notion workspace. This license terminates when you disconnect your platforms or close your account.

Insights and analysis generated by Lexi Connect based on your data are delivered to you and become part of your Notion workspace. You own the output. We may retain anonymized, aggregate statistics (e.g., average processing times, feature usage counts) that cannot be traced back to any individual user or business.

8. Your Compliance Obligations

You are responsible for ensuring your use of the Service complies with all applicable laws and the terms of your connected platforms, including:

  • GDPR/CCPA: You must have a lawful basis for processing customer data that flows through the Service
  • Platform terms: You must comply with Shopify, Klaviyo, Attentive, Meta, Google, and Notion terms of service
  • Data governance: You are responsible for managing access to your Notion workspace and controlling who on your team sees the data Lexi Connect delivers

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. Please review it carefully. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Service Level Agreement

Our commitment to service availability, support response times, and service credits for downtime is detailed in our Service Level Agreement (SLA). Paid subscribers are entitled to the remedies described in the SLA when uptime commitments are not met.

11. Intellectual Property

The Service — including its code, design, analysis engine, prompt templates, and documentation — is the intellectual property of Experience Email, LLC and is protected by copyright, trademark, and other applicable laws. You may not copy, modify, or create derivative works based on the Service.

“Lexi Connect,” “The Email Experience,” “E/X,” and associated logos are trademarks of Experience Email, LLC. You may not use these marks without written permission.

12. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails and remains unresolved after the retry period
  • We are required to do so by law
  • We reasonably believe your use poses a security risk to the Service or other users

You may terminate your account at any time by canceling your subscription and contacting support to request account deletion. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) analysis, insights, or recommendations will be accurate or complete; (c) any errors in the Service will be corrected; or (d) the Service will meet your specific requirements.

AI-generated content (Morning Insights, ticket descriptions, recommendations) is provided as informational guidance and should not be relied upon as the sole basis for business decisions.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPERIENCE EMAIL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any inaccuracy in analysis, insights, or AI-generated content
  • Unauthorized access to your data resulting from circumstances beyond our reasonable control
  • Third-party platform outages, API changes, or data quality issues
  • Business decisions made based on information provided by the Service

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Experience Email, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including the terms of connected platforms; or (d) your data or content.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida.

17. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

18. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy and SLA, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
